Police forbade Whatcott from taking any pictures of them while they searched his car for guns. This photo was taken in defiance of the police order. Bill Whatcott used his camera phone to take this picture. Bill Whatcott looked straight ahead, acted like he was talking on the phone and did not look at the police when he took it. Does this police huddle and the multiple police cruisers involved look like a typical police response to a seat belt violation to you?


Dear Friends:
Early this morning I headed out to the Calgary Courthouse to plead not guilty to my trespassing charge which I acquired last month at the University of Calgary. This charge is in relation to my flyer distribution exposing Premier Stelmach and homofascism at the Alberta Human Rights Commission. When I got there I got to walk into a courtroom and hear the life history (or at least the criminal history) of a 40 something year old native woman. Her record started in 1983 and included about 3 assaults, about 4 or 5 thefts, 6 failure to comply with court order and about 6 failure to appears. Also on her record was a number of drunk driving and driving while disqualified convictions. The crown prosecutor stated given this is her fourth assault (the lady was arrested beating up another lady on the front lawn of her victim’s house) and the lady has quite a history of not complying with bail conditions and court dates with some of those non compliances being this year, April 2008, the crown recommended a “substantial” bail before allowing the lady out of jail. In my world given this lady was breaching bail only 5 months ago and had an accumulated record of over 20 convictions I wondered why she was getting bail at all. Anyways the judge and crown got tough with this lady all right. Seeing as she had no job, they reasoned a $150.00 bail was substantial enough to insure this gal might show up in court and stay off the booze until trial. What a joke.......

After letting the aboriginal lady go the judge directed me to a Justice of the Peace counter where I plead not guilty and was given a December 3rd trial date at 2:00 PM. From there I had lunch with John Carpay of the Canadian Constitution Foundation. It was a blessed hour and Mr. Carpay said he would look at my trespassing charge to see if they are able to help with it.

From lunch I headed back to Edmonton. As I got onto Highway 2, I noticed a police cruiser behind me but did not give him much thought other than he seemed to be behind me for a long time. After about 10 minutes of driving 4 cruisers and a police van showed up and then their lights went off instructing me to pull over. At first I thought the police were on a separate call and would pass me but no it was me they were after. The time now was a little after 3:00 PM.

I was shocked at the fire power the police used to pull me over. It was a couple minutes before police got to my door. So I called John Carpay to inform him what was happening. When the police finally got to my door I asked him (Constable P Wright) why they pulled me over with such firepower. 3 police officers came to my passenger side and two came to my driver’s side. I think one or two stayed behind my car. Officer Wright informed me he was concerned I might not be wearing a seatbelt. I believe my seatbelt was still on when he got to my door and I informed him I was wearing it. He acknowledged the obvious and proceeded to request my ID. The police took my driver’s license and firearms license and ordered me to put away my cell phone.

Now the police started questioning me on if I had any firearms in my vehicle or on my person. I told them “no” to both. They asked me to step out of the car and requested to search my car and my person. I gave permission and stated repeatedly as I was asked repeatedly “no” to each question on whether or not I had firearms in the car or on my person. After about 15 minutes of this humiliating display on the side of highway 2 during rush hour traffic I requested my camera so I could photograph the search. Constable S Martin in a very rough tone of voice refused permission and stated I was not allowed to photograph the search. After a few more minutes of searching I was ordered back into my car and denied permission to phone my lawyer and ordered to keep cell phone and camera on the back seat and not touch either while police were dealing with me.

After about 5 minutes I concluded the denial of calling my lawyer was illegal and grabbed my phone to do just that and sneaked one shot of the police behind my car in the process. (See picture above) I sought Mr. Carpay’s advice on the search and denial of phone and camera. A few minutes later Constables Wright and Martin came to my car, reprimanded me for phoning my lawyer when they told me to leave my cell phone alone and issued me a $115.00 ticket for a seat belt violation that never happened. When the police left my car Mr. Carpay suggested I get their Identifications before they pull away. I was about 150 yards down the road when Mr. Carpay gave me this advice. A couple cruisers already left but 2 cruisers and the police van were still on the side of the highway so I backed up to them and got out with my book to get their identification. When I got to the window of the police van the two officers looked at me and abruptly pulled away without speaking. I got the van’s number though. It was unit 2107.

Constable P Wright was in the next police car and he promptly and politely allowed me to get his name off his badge. I got S Martin next but he was hostile and tried not to let me get his name. He warned me I would get another ticket if I did not leave the area immediately.

I will be back in court to fight the bogus seatbelt ticket charge in Calgary on September 26/ 2008. Please pray for justice to prevail in this matter.

5 policemen for a seatbelt violation that never happened?? surprise1

I am not a lawyer, but they have no right to harass you and search your car for guns unless they do have a search warrant right?
